Terms of Service

These Terms of Service govern your access to and use of Del, a service operated by Human Interface, Inc., a Delaware corporation (“Human Interface,” “we,” “us,” or “our”).

In these Terms, Del is referred to as the “Service.” By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Your Content

You retain ownership of the content you submit to the Service (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and improve the Service and to provide the features you request (including sending content to third-party AI providers that power those features).

You are responsible for Your Content and for ensuring you have the rights necessary to submit it.

4. Acceptable Use

You agree not to:

  • Use the Service to violate any law or infringe the rights of others.
  • Upload or transmit malware, spam, or content that is unlawful, harmful, harassing, or otherwise objectionable.
  • Attempt to reverse engineer, scrape, or interfere with the Service or its infrastructure.
  • Use the Service to build a competing product or to train machine learning models.
  • Bypass rate limits, quotas, or any access controls we implement.

5. Third-Party Integrations

The Service integrates with third-party services (such as Google Calendar and SMS providers). Your use of those services is governed by their own terms, and we are not responsible for third-party services.

6. AI Service

Del is an artificial intelligence system, not a human. Del’s messages are generated automatically, including when a Human Interface employee has reviewed a request or provided guidance. When a human reviews a request or provides guidance through Del, Del will disclose that involvement in the conversation, unless notice is prohibited by law or would compromise a security investigation.

The Service includes features powered by artificial intelligence. Outputs are generated automatically and may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing AI output before relying on it.

7. Safety and Crisis Resources

Del is not a therapist, healthcare provider, crisis counselor, or emergency service. Del may provide crisis-resource information, but it cannot provide medical care or guarantee that an emergency will be detected or addressed. In the United States, call or text 988 for crisis support and call 911 for an immediate life-threatening emergency.

Companion chatbots may not be suitable for some minors.

Suicide and Self-Harm Safety Protocol

When a user expresses suicidal ideation or self-harm, Del is instructed to respond supportively, ask brief questions needed to understand immediate safety, and provide crisis-resource information. In the United States, Del refers users to the 988 Suicide & Crisis Lifeline by call or text and directs users to call 911 or go to the nearest emergency room for an immediate life-threatening emergency. Del may also encourage the user to contact a trusted person and, when safe to do so, create distance from anything they could use to harm themselves.

Del distinguishes current danger from historical or quoted material by checking whether the user is safe now. Del does not provide medical care, contact emergency services on a user’s behalf, or guarantee that suicidal ideation or self-harm will be detected or addressed.

8. Fees

The Service may be offered free of charge or as a paid plan. If fees apply, they will be presented to you before you commit. Unless otherwise stated, fees are non-refundable.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMAN INTERFACE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You will indemnify and hold harmless Human Interface and its affiliates from any claim, demand, or damages arising out of your use of the Service, Your Content, or your violation of these Terms.

13. Changes

We may modify these Terms from time to time. If we make material changes, we will provide notice (for example, by updating the “Last updated” date or notifying you in-product). Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
